Jothimani v. S. Kaliraj

C.M.P.No.3721 of 2024 in C.M.A.SR.No.73029 of 2022 KRISHNAN RAMASAMY, J.

This petition has been filed to accept the cause title in the above appeal.

2. The learned counsel for the petitioner would submit that at the time of accident, there were five legal heirs, who were claimants in the claim petition filed before the Tribunal, in which the award was passed on 09.07.2018. In the meantime, the 5th claimant was died.

3. Further, he would submit that after the demise of the 5th claimant, only the petitioners herein are the surviving legal heirs of the deceased and hence, he requests this Court to accept the cause title in the above appeal.

4. By recording the above submissions made by the learned counsel for the petitioners, this petition is allowed.

5. The Registry is directed to carry out the necessary amendments and list the above appeal in the regular course.
