ORDER : The Court Made the following order :- The petitioner apprehends arrest by the respondent police for the offences punishable under Sections 7, 20(1) of COTPA Act 2003 and Sections 52, 59 of Food Safety and Standards Act, 2006 and under Sections 273, 328 of IPC, in Crime No.872 of 2021, is before this Court seeking anticipatory bail.

The petitioner is arrayed as A3 in this case relating to seizure of nearly 1870 Kg of tobacco products worth about Rs.11,69,928/-.

The specific case of the prosecution is that Rs.11,69,928/- worth tobacco seized from the vehicle driven by the second accused. This petitioner is the owner of the vehicle, as per the confession statement given by the load man and the driver of the vehicle. The petitioner herein seeks anticipatory bail on the ground that he is innocent. However, the investigation so far conducted implicates the petitioner is the main brain behind the transportation of the contraband worth around rupees twelve lakhs.

Considering the above facts, this Court is not inclined to entertain this anticipatory bail petition.
