CRIME NO.372 OF 2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Modify the condition imposed in Para 6(a) in Crl.OP.1612/2022 order dated 25.01.2022(i.e) to deposit a sum of Rs.5,00,000/-(Rupees Five Lakhs only) to the Credit of the Crime No.372/2022 and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S R.C.PAUL KANAGARAJ, Advocate for the petitioner and of M/S.L.BASKARAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- The present petition has been filed to modify the condition that the petitioners were directed to deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.372 of 2021 imposed by this Court in Crl.O.P.No.1612 of 2021 dated 25.01.2022.

2. This Court, vide order dated 25.01.2022, directed the petitioners to deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.372 of 2021.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. He further submitted that they are unable to mobilize the funds. Hence, the present modification petition has been filed before this Court.

4. The learned Government Advocate (Crl.Side) submits that the petitioners have not complying with the conditions imposed by this Court.

5. Considering the facts and circumstances of the case, reason is not justifiable and the petitioners have not complied with the conditions imposed by this Court in Crl.O.P.No.1612 of 2022. this Court is not inclined to modify the conditions imposed on the petitioners.

6. Accordingly, this Criminal Miscellaneous Petition is dismissed.
