2016-07-05Honourable Mr Justice P. N. Prakash2 pages

IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 05.07.2016

CORAM:

THE HONOURABLE MR.JUSTICE P.N.PRAKASH Crl.O.P.No.11546 of 2016 P.Murali .. Petitioner Vs.

1.The State of Tamil Nadu, Rep. by the Commissioner of Police, Vepery, Chennai-7.

2.The Inspector of Police, E-3, Thousands Light Police Station, Chennai.

.. Respondents Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure praying to pass appropriate order directing the respondent not to harass the petitioner unnecessarily.

For Petitioner : No Appearance For Respondents : Mr.C.Emalias Additional Public Prosecutor

O R D E R

This Criminal Original Petition has been filed to direct the respondent not to harass the petitioner unnecessarily.

2. No representation for the petitioner may be on account of boycott of Courts. However, in Harish Uppal [Ex.Capt.] Vs Union of India, reported in [2003] 2 SCC 45, the Hon'ble Supreme Court has held that boycott of Courts is illegal and therefore, this Court perused the records, heard the learned Additional Public Prosecutor and passed orders.

3. It is seen that the petitioner has borrowed a sum of Rs.2,80,000/- as personal loan from ICICI Bank and there appears to be some dispute with regard to repayment of the money and that the agents of the Bank are frequently coming and demanding repayment. Therefore, the petitioner has sent a representation dated 29.02.2016 to the Commissioner of Police, Chennai, by post.

4. When an amount is due from a borrower, it is but natural for the Bank to take steps to realise the amount, and that cannot be called as harassment.

Hence, the petition is devoid of merits and accordingly dismissed.
