ORDER

This Writ Petition has been filed seeking for issuance of a Certiorari, to call for the records on the file of the 4th respondent in his proceedings nil. dated 28.01.2025 and quash the same.

2.Heard the learned counsel on either side.

3.Today, when the matter is taken up for hearing, the learned 2/5

Standing counsel appearing for the respondents 1, 2, 4 & 5 has submitted that the notice has been issued under the Old Act i.e., the Chennai City Municipal Corporation Act IV of 1919 whereas, subsequently, the Tamilnadu Urban Local Bodies Rules, 2023 has come into effect in the year 2023. He further submits that since the notice dated 28.01.2025 is issued by following the Old Act, the same is liable to be set aside. 4.In view of the above submission, this Writ Petition is disposed of and the impugned notice dated 28.01.2025 is set aside and the respondents 1 & 2 are granted liberty to proceed afresh as per the provisions of the Tamilnadu Urban Local Bodies Rules, 2023.

No costs.
