ORDER

(Order of the Court was made by M.Duraiswamy, J.) The petitioner has filed the above writ petition to issue a Writ of Certiorari to call for the records of the impugned order bearing reference Na.Ka.No.963/2015/Tha.Ma, dated 31.01.2019 passed by the third respondent and quash the same.

2. On a careful consideration of the materials available on record, it could be seen that the third respondent had issued the

impugned notice dated 31.01.2019 under Sections 56 and 57 of the Tamil Nadu Town and Country Planning Act, 1971.

3. Since the petitioner has got remedy by way of appeal under Section 80-A of the Tamil Nadu Town and Country Planning Act, 1971, the writ petition filed under Article 226 of the Constitution of India cannot be entertained.

4. In view of the above, we are not inclined to entertain the writ petition. Accordingly, the writ petition is dismissed. It is open to the petitioner to file an appeal under Section 80-A of the Tamil Nadu Town and Country Planning Act, 1971 before the Appellate Authority in accordance with law. No costs. Consequently, W.M.P.No.3828 of 2019 is closed.
