A.No.3271 of 2020 in C.S.No.789 of 2017 A.No.3271 of 2020 in C.S.No.789 of 2017 R.PONGIAPPAN, J., This application has been filed seeking the relief to set aside the order dated 11.10.2018 in A.No.8541 of 2017 in C.S.No.789 of 2017 passed by the learned Master.

2. Previously, the very same applicant herein filed an application in A.No.824 of 2020 praying for the relief to condone the delay in filing the appeal and to set aside the order passed by the learned Master. In this regard, vide order dated 13.10.2020, this Court passed a conditional order, directing the applicant / defendant in A.No.8541 of 2017 to deposit a sum of Rs.10,00,000/- (Rupees Ten Lakhs Only) to the credit of the suit on or before 30.11.2020. Further, ordered that on such deposit being made, the order passed by the learned Master, refusing to grant leave stands set aside and consequentially, the applicant / defendant may permitted to file the written statement to contest the suit on merits.

3. By obeying the said order, the applicant / defendant herein deposits a sum of Rs.10,00,000/- (Rupees Ten Lakhs Only) on 23.11.2020 in favour of the Registrar General, High Court, Madras. Further, he has filed a memo to that effect.

4. In view of the above, this application stands allowed.

5. Registry is directed to post this matter before the learned Master on 02.03.2021 for further proceedings.
