The petitioner/A2 seeks anticipatory bail in Crime No.27 of 2023 registered by the respondent Police for the offences punishable under Sections 8(c), 20(b)(ii) (B), 29(1) of NDPS Act.

2. It is the case of the prosecution that A1 was found in possession of 1.100 grams of Ganja and had been remanded into judicial custody on 30.12.2023. At the same time, the respondent had also noticed this petitioner who was standing nearby and had tried to apprehend him but he dropped the bag and mobile phone and had run away. From the bag 1.100 grams of ganja had been seized. There is one previous case as against the petitioner herein.

3. Strong objection had been raised by the respondent and the learned Government Advocate(Crl.Side) stated that substantial portions of the ganja had been recovered from the bag dropped by the petitioner. 1/3

4. The learned counsel for the petitioner stated that the seizure is only intermediate quantity but in the counter it had been stated that further facts will have to be determined, particularly since it is alleged that this petitioner is the seller of ganja to A1.

5. In view of these facts, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
