Balu @ Balamurugan v. The Station House Officer

Crl.OP No.11551 of 2016 S.VAIDYANATHAN, J The petitioners, who are arrayed as A1 and A2, apprehend arrest at the hands of the respondent police for alleged offences punishable under Sections 379 IPC in Crime No.73 of 2016 on the file of the respondent police and hence seek anticipatory bail.

2. The case of the prosecution is that the petitioners are alleged to have committed theft of two wheeler.

3. The learned counsel appearing for the petitioners submitted that the petitioners were already arrested by Thirukoilur Police in connection with Crime No.277 of 2016 and based on the confession statement, they have been falsely implicated in the presebt case.

4. The learned Government Advocate (Crl.side) strongly opposed to grant anticipatory bail to the petitioners stating that they were involved in another case. He further submitted that there is no change of circumstances to consider this petition.

5. Considering the fact that the offence alleged against the petitioners are grave in nature and the earlier anticipatory bail petition was dismissed by the Principal District and Sessions Judge, Villupuram in Crl.M.P.No.2795 of 2016 dated 27.05.2016, I do not find any change of circumstances to consider this petition. Accordingly, this Criminal Original Petition is dismissed.
