[Respondent] Petition filed under Section 482 of the Criminal Procedure Code, to pass an order directing the learned Principal District and Sessions Judge cum Special Judge for cases under SC/ST Act, Perambalur to accept the surrender and pass orders in the bail application to be filed by the petitioners in Crime No.358 of 2017 pending investigation on the file of the respondent on the same day of their surrender.

ORDER

The petitioners, who apprehend arrest for the offences punishable under Sections 147, 148, 447, 294(b), 323, 324 and 506(ii) IPC and Section 3 (i) (r) and 3 (i) (s) of the SC/ST (Prevention of Atrocities) Amendment Act, 2015 in Crime No.358 of 2017 on the file of the respondent Police, have filed this petition seeking a direction to the learned Principal District and Sessions Judge cum Special Judge for cases under SC/ST Act, Perambalur to consider their bail application on the same day of their surrender, on merits.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who takes notice for the respondent.

3.Considering the facts and circumstances of the case, the learned Principal District and Sessions Judge cum Special Judge for cases under SC/ST Act, Perambalur is directed to accept the surrender of the petitioners and consider their bail application on the very same day purely on the basis of merits and to pass suitable orders, in the event of the petitioners surrendering before the said court within 15 days from today and filing of petition seeking bail.

4.This petition is ordered accordingly.
