Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 05.10.2019 and fix the petitioner's pay in the cadre of Secondary Grade Middle School Headmaster with effect from 24.06.1999 i.e., the date on which the petitioner was promoted as Secondary Grade Middle School Headmaster and served for a period for 24.06.1999 - 01.06.2000 and pay all the consequential pay arrears and other pensionary benefits to the petitioner.

This writ petition has been filed for issuance of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 05.10.2019 and to refix the pay of the petitioner and to pay him the arrears along with other terminal benefits.

2.It is seen from records that the petitioner had retired from service in the year 2002. He made a representation in the year 2017 based on some orders that were passed in a writ petition, where, the relief was granted to some other petitioner. The petitioner wants his representation to be considered in line with the order that was passed by this Court in W.P.No.39726 of 2016.

3.In the considered view of this Court, the present writ petition is hit by latches and the petitioner who had retired in the year 2002 is seeking for relief based on some order passed by this Court in the year 2016 and such an attitude cannot be entertained by this Court.

4.In the result, this writ petition stands dismissed. No Costs.
