O R D E R

This Civil Revision Petition has been filed challenging the impugned order dated 07.01.2025 passed by the Sub Court at Coonoor in I.A.No.4 of 2024 in O.S.No.106 of 2023.

2.The petitioner is the plaintiff and respondent is the defendant in the suit. The suit is filed for declaration and injunction. During the course of trial, the

petitioner filed I.A.No.4 of 2004 on the file of the Sub Court at Coonoor, in O.S.No.106 of 2023, seeking leave of the Court to receive additional documents and mark the same as exhibits on the side of the petitioner. The same has been dismissed under the impugned order dated 07.01.2025 by the Trial Court on the ground that those documents are irrelevant for the suit. Admittedly, the leave application filed by the petitioner seeking leave of the Trial Court to file a reply statement has been allowed. In the said reply statement, pleadings have also been made by the petitioner with regard to the documents for which leave was sought for in I.A.No.4 of 2024 for receiving the said documents from the Trial Court. When the Trial Court has permitted the petitioner to file a reply statement, necessarily I.A.No.4 of 2024 filed by the petitioner in O.S.No.106 of 2023 ought to have been allowed.

3.Admittedly, the documents filed by the petitioner through I.A.No.4 of 2024 in O.S.No.106 of 2023 are all certified copies. However, the Trial Court has failed to consider the same and has erroneously rejected the application filed by the petitioner. After giving due consideration to the aforesaid factors, this Court is of the considered view that the order passed by the Trial Court which is the subject matter of the Civil Revision Petition is erroneous and it has to be interfered with, by this Court through this Civil Revision Petition.

4.Accordingly, the impugned order dated 07.01.2025 made in I.A.No.4 of 2024 in O.S.No.106 of 2023 on the file of the Sub Court at Coonoor is hereby set aside by this Court and this Civil Revision Petition is allowed by directing the Trial Court to receive the additional documents filed by the petitioner through I.A.No.4 of 2024 and mark the same as Exhibits on the side of the petitioner, subject to admissibility, proof and relevance.
