Respondents in both writ petitions W.P.Nos.11390 and 11392 of 1998 filed under Article 226 of the Constitution of India praying for issue of Writ of certiorarified mandamus calling for the records on the file of the second respondent herein in his proceedings in Lr.No.F.EI/AE (c) dated 26.9.1997 and to quash the same and forbear the respondents from forcibly taking possession of the petitioners' property.

COMMON ORDER There was no representation for both sides yesterday, i.e., 07.11.2017. The matter was passed over in the forenoon and called in the afternoon. In the afternoon, in the second call also, there was no representation. Therefore, the matter was directed to be posted under the caption 'For dismissal' today, i.e., 08.11.2017.

Today (08.11.2017), though the matter was listed under the caption 'For dismissal', when the matter was called in the forenoon, there was no representation on behalf of the petitioners and first respondent. Learned Government Advocate appearing for respondent Nos.2 to 4 was present. With the intention of giving one more opportunity to the learned counsel for the petitioners and first respondent, the matter was passed over and it was called again in the afternoon. There was no representation for the petitioners and first respondent in the afternoon also, i.e., in the second call also. Therefore, both writ petitions are dismissed for default / non prosecution. No costs. Consequently, connected miscellaneous petitions are closed.
