Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying to quash the Government of India, Ministry of Defence Letter No.12 (16)/86/D/(pen/sers) dated 26.08.1993, based on which the respondents claim to have acted to grant family pension to her only from the date of FIR namely 26.10.2002, as unconstitutional and direct the respondents to grant and pay the petitioner, her eligible family pension for the intervening period from 29.03.1992 till 26.10.2002 i.e., the date from which her husband was declared missing till the actual date of commencement of family pension and pay the arrears of pension due to her with 12% interest on the amount due till the date of effecting payment.
