This Criminal Original Petition is filed to transfer the above said Crime No.205 of 2021 pending on the file of the 3rd respondent to the Central Bureau of Investigation who are the competent authority to investigate further and submit a final report.
2. The petitioner/Kannan, is the husband of K.Samanthakamani. In his petition, he has prayed for transfer of investigation from Central Crime Branch to Central Bureau of Investigation. Relying upon a communication of the 1st accused/Kutti Padmini made to the Inspector of Police during the year 2017, this petition is filed seeking transfer of investigation.
3. This Court finds no merit in this petition to transfer the complaint which is purely civil in nature and does not warrants to be 2/4
investigated by Central Bureau of Investigation. Hence, this Criminal Original Petition No.4092 of 2023 is dismissed.
4. In view of the order passed in main Criminal Original Petition, there is no necessity to implead the proposed 5th respondent as respondent No.5 in Crl.O.P.No.4092 of 2023. Hence, the Criminal Miscellaneous Petition No.4064 of 2023 is dismissed.
