ORDER

This Criminal Original Petition has been filed seeking for a direction to learned IX Metropolitan Magistrate, Saidapet, Chennai to expedite the trial in C.C.No.11603 of 2008 and dispose the case.

2. It is seen that the complaint filed in C.C.No.11603 of 2008 for an offence under Section 138 of the Negotiable Instruments Act on the file of the Learned IX Metropolitan Magistrate, Saidapet, Chennai. It is also seen that from the history of the case hearing, it is posted for so may occasions. Now, the learned counsel for the petitioner has filed a proof affidavit. Therefore, without any process, it is just pending for trial.

3. Considering the facts and circumstances of the case and also considering the Calendar Case of the year is 2008, this Court deems it fit to direct the learned IX Metropolitan Magistrate, Saidapet, Chennai to complete the trial proceedings in C.C.No.11603 of 2008 within a period of three months from the date of receipt of a copy of this order.

4. With the above direction, this Criminal Original Petition is disposed of.
