Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus, to call for the records of the second respondent in Ma.A8,Na.Ka.No.C3/4554/2017 dated 19.6.2017 and Ma.A8,Na.Ka.No.C3/4554/2017 dated 8.1.2018 quash the said orders of the second respondent dated 19.6.2017 and 8.1.2018 and consequently direct the respondents to provide employment on compassionate basis to the petitioner in the office of the second respondent.

ORDER
This writ petition is directed against the impugned order passed by the second respondent-Zonal Officer-8, Greater Chennai Corporation rejecting the request of the petitioner for appointment on compassionate ground, citing a reason that after the death of the petitioner's father Mr.K.Kondal Rao, his mother Mrs.K.Latha (Employee No.801611) is working as a Scavenger in the office of Zone-8, Part-21, Division-94 of Greater Chennai Corporation.

2. The submission of the learned counsel for the petitioner that there are Government Orders stating that if any other member in the family of the breadwinner who died while in service is also employed, still, the compassionate appointment should be considered, does not carry weight. The reason is that when the petitioner has sought for compassionate appointment that his father passed away while in service, there is no indigence prevailing in his family. When the petitioner was not dependent upon the salary received by his late father Mr.K.Kondal Rao, since his mother is also employed as a Scavenger even today, the impugned order refusing compassionate appointment to the petitioner cannot be found fault with.
