The petitioner, who was arrested and remanded to judicial custody on 12.01.2023 for the offences punishable under Sections 465, 466, 471 and 409 of IPC in Crime No.10 of 2023 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner, being the Head Clerk of IV th Additional District Judge, Bhavani had misdirected the Bank Manager, Bank of Baroda, Pallipalayam, Namakkal to transfer a sum of Rs.4,08,930/- from the investment amount in MCOP cases to his own bank account by forging the signature of the Judge. Hence, the complaint.

The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. He would further submit that he will abide by any condition that may be imposed by this Court. He would also submit that the petitioner has been suffering incarceration from 12.01.2023. Hence, he prayed to grant bail to the petitioner.

The learned Government Advocate (Crl.side) for the respondent police submitted that the petitioner, being the Head Clerk of IV th Additional District Judge, Bhavani had misdirected the Bank Manager, Bank of Baroda, Pallipalayam, Namakkal to transfer a sum of Rs.4,08,930/- from the investment amount in MCOP cases to his own bank account by forging the signature of the Judge. He further submitted that investigation is at crucial stage, if the petitioner is granted bail, he will tamper the witnesses and hamper the investigation. Hence, he vehemently opposed for grant of bail to the petitioner. 5.Considering the facts and circumstances of the case, investigation is at crucial stage and gravity of offence, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed.
