The relief sought by the petitioner in this writ petition is to call for the records and quash the appeal summons dated 29.08.2016, 22.09.2016, 11.11.2016, 25.11.2016, 02.06.2017, 05.08.2017, 24.11.2017 and to forbearing the Respondents from passing further order in appeal pending before them in vide e/f/vk;4-41636-2015-2016 filed by the fifth respondent and to take contempt action against the respondents for acting beyond their scope irrespective of an order passed by this Hon'ble Court.
2. This Court vide its order dated 25.03.2019 directed the concerned Revenue Officials to grant patta in favour of the petitioner and cancel the patta, which was wrongly issued in favour of the fifth respondent herein and consequently when the patta was also granted in favour of the petitioner in obedience of the said order, the Revenue Officials are not entitled to proceed Page No.2 of 5
with further enquiry, based on an appeal preferred by the fifth respondent, without challenging the order passed in W.P.No.15061 of 2014 dated 22.01.2015.
3. Learned counsel appearing for the fifth respondent submitted that challenging the cancellation of patta, the fifth respondent has filed an appeal before the first respondent/The District Collector, Thiruvannamalai.
4. Learned Additional Government Pleader appearing for the respondents 1 to 4 submitted that the aforesaid appeal, which was filed by the fifth respondent has been rejected by the first respondent/The District Collector, Thiruvannamalai vide order dated 16.07.2019.
5. In view of the above, nothing survives in the writ petition for further adjudication and the same has become infructuous.
