men, servants, agents or any one acting under them, from in any manner proceeding with any further construction over the petitioner's property more clearly described in the schedule A and B to the judges summons filed herewith, pending disposal of the present suit. This original application coming on this day before this court for hearing, the Court made the following order:

When the matter is taken up for hearing, the learned counsel appearing for the applicant would draw the attention of this Court to paragraph No.4 of the counter filed on behalf of the first respondent and the same is extracted hereunder:

"4. I most humbly make it clear that the 1 st respondent their men, servants, agents or anyone acting under the 1 st respondent will not put up any construction whatsoever in the property described in Schedules A and B to the Judge's summons, pending disposal of the above suit."

2. In view of the categoric statement made in the above paragraph of the counter filed by the first respondent, the interim order passed in O.A.No.237 of 2021 stands closed as no furthers orders are necessary in the said application.
