This Criminal Miscellaneous Petition has been filed seeking for an order to restore the Crl.R.C.No.835 of 2013 dated 21.04.2014 which was dismissed for non prosecution.

2. The petitioner submits that due to non representation, non bailable warrant was ordered to be issued by this Court on 31.01.2014. Thereafter, he was arrested on 03.07.2023 and since then he is detained at the Central Prison, Coimbatore.

3. He further states that he is 73 years old and he is suffering from High Sugar, Blood Pressure and other ailments.

4. The learned counsel for the petitioner submits that the petitioner is ready to settle the matter.

5. Mr.R.Ganesh Kanna, learned counsel appearing for the 1/4

1st respondent submits that though the petitioner is in incarceration, that would not benefit either party. As the petitioner is ready to settle the matter, the learned counsel for the 1st respondent has no serious objection to allow this petition.
