O R D E R
The application had been taken out by the claimant under Section 15(2) to substitute the Arbitrator, who was earlier appointed by this Court.
2. This Court by its order dated 19.03.2024 had appointed Hon'ble Mrs.Justice Chitra Venkatraman, Retired Judge of this Court to enter upon reference to resolve the dispute between the parties. Thereafter, the proceedings had been contintued and it is informed that the pleadings have been completed. However, the learned counsel for the respondent sought indulgence of this Court to permit to file additional pleadings.
3. At that juncture, when the proceeding was taken on 28.08.2025, the learned Arbitrator, who was appointed, expressing her inability to hear the case for the reasons recorded therein wanted to recuse herself and terminate the mandate. On the Minutes that has been recorded on 04.09.2024, the present application had been filed. In view of the learned Arbitrator appointed by this Court had recused herself for the reasons stated in the order dated 04.09.2024, this Court discharges her as Arbitrator and appoints Hon'ble Mr. Justice R.Suresh Kumar, Retired Judge of this Court residing at P-Block, 2nd Floor, 6th Flat, Taisha-2, TNHB Complex, West Natesan Nagar, Virugambakkam, Chennai-600 092, Mobile No.9444-087-353 and he would be entitled to fix his fees.
4. The learned Arbitrator is requested to proceed from the stage where the proceedings have stopped in the arbitration proceedings.
5. The learned Arbitrator, Hon'ble Mrs. Justice Chitra Venkatraman, Retired Judge of this Court, appointed earlier is also requested to transmit the records of the proceedings to the Hon'ble Mr. Justice R.Suresh Kumar, Retired Judge of this Court as expedicuously as possible, on receipt of this order.
