ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 24(1) of Cigarette and Other Tobacco products Act, 2003 & 77 of the Juvenile Justice ( CIS and Protection of Children) Act 2015 in Crime No.6 of 2026 on the file of the respondent police seeks anticipatory bail. 1/4

2. The case of the prosecution is that on 06.01.2026 the respondent police conducted a raid for prohibited gutka products and found that the petitioner was in possession of 178 kgs of banned tobacco products. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that there is no allegation or material to indicate that the petitioner has committed any offence. He further submitted that the FIR does not disclose the quantity of tobacco products allegedly seized. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there is no previous case pending against the petitioner. He further submitted that the quantity involved in this case is very huge and investigation in this case is pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the submissions made by both sides and even though there is no previous case pending against the petitioner, the quantity involved in this case is very huge and investigation in this case is pending , I am not inclined to grant anticipatory bail to the petitioner.
