Mr.S.K.Rameshwar, learned standing counsel takes notice for the respondents 1 to 4. Since this writ petition is being disposed of without affecting the interest of the fifth respondent, notice to the said respondent is dispensed with.
2. The petitioner seeks for a mandamus directing the third respondent to consider his representation dated 05.12.2017 to effect change of the petitioner's name and for restoration of electricity service connection in service No.657-007-3.
3. Perusal of the proceedings annexed in the typed set of papers would disclose that as early as on 19.02.2015, an order was passed by the fourth respondent directing the petitioner to rectify such defects pointed out by the Department, so as to enable the Department to consider his application, which includes the pendency of the suit between the petitioner and the fifth respondent. Without challenging the said proceedings, the petitioner has filed the present writ petition, that too, seeking for mandamus.
4. The learned standing counsel for the respondents 1 to 4, based on instructions, submitted that the service connection has already been restored and however, insofar as the name change is concerned, the fifth respondent is objecting in view of the pendency of the suit.
5. In any event as the present writ petition is filed for mandamus, without challenging the order dated 19.02.2015, I do not think that the present writ petition is maintainable. Accordingly, this writ petition is disposed of, by granting liberty to the petitioner to agitate the said order dated 19.02.2015 in a manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
