Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records on the file of the first respondent in connection with the order passed by him in G.O.Ms.No. 672 Home (Court-V) Department dt. 27.07.2010 and quash para 6 of the said order as it is against the order passed by the Hon'ble Apex Court Page No.1 of 4
in W.P.(C) No. 1022/99, dated 07.10.1999 and direct the Respondent to pay the advance increment as directed by the Hon'ble Apex Court forthwith by issuing a writ or order or direction in the nature of writ of certorarified Mandamus and direct the respondents to implement the Shetty Commission's recommendation as per the order of the Hon'ble Apex Court in W.P.No. 1022/1989 dated 15.07.2008 and 07.10.2009 immediately with all monetary and service benefits with 18% interest.

(Order of this Court delivered by S.M.SUBRAMANIAM,J.) In view of the Government Order passed in G.O.Ms.No.672 Home (Courts-V) Department dated 27.07.2010, the benefit of one increment granted to Court Staff were extended to the Process Servers (Junior Bailiff). The amendment issued reads as under:

"The pay Scale of Process Servers (Junior Bailiff) be revised from the scale of pay Rs.2650-65-3300-70-4000 to the scale of pay of Rs.3050-75-3950-80-4590 with effect from 01.04.2003. Consequently pay scale for Junior Bailiff shall be Rs.3050-4590 (Group 'C') which is immediately below the pay scale of Junior Assistant Rs.3200-4900 (Group 'C'). Thus this recommendation has been complied with."
