O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS Act and 21(1) of Mines and Minerals (Development & Regulation) Act, in Crime No.1 of 2026 on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that when the respondent police was conducting a raid, the petitioner along with other accused was involved with illegal transportation of 9 units of River sand from the State of Andhra Pradesh. Hence, the case.

3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case and has not involved in any offences as alleged by the prosecution; and that the petitioner is ready to abide by any conditions that may be imposed by this Court. He further submitted that co-accused in this case has been granted anticipatory bail. Hence he sought for anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. Side) appearing for the respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that as per the complaint, the petitioner is the main accused in this case. Hence, he opposed to grant anticipatory bail to the petitioner

5. Considering the submissions made by both sides, even though it is stated that the co-accused in this case has been granted anticipatory bail, 2/4

taking note of the fact that the petitioner is the main accused in this case this Court is not inclined to grant anticipatory bail to the petitioner.
