ORDER

This criminal original petition was referred for mediation to Tamil Nadu Mediation and Conciliation Centre, High Court, Madras.

2. A communication dated 16.06.2015 of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, enclosing a copy of its report dated 30.03.2015 has been received, wherein it is stated as follows:-

"Both the parties appeared before the Centre along with their counsel. Matter has been settled between them as per the terms cited in the Mediation Agreement enclosed. Hence, the matter is sent back to the Hon'ble Court."

3.As the parties have arrived at a settlement in terms of the Mediation Agreement dated 30.03.2015, this criminal original petition is listed for passing of an order in terms of the settlement. 4.The Mediation agreement dated 30.03.2015, signed by the parties and their respective counsel reads as follows:- "1. The parties to the above said criminal original petition have arrived at a settlement among themselves and have entered into a Memo of Compromise to withdraw the complaint in Crime No.1 of 2014 given by the intervenor/defacto complainant. As the issues are settled amicably the parties in the above said proceedings does not want to continue the litigation and hence filing this compromise memo.

2.The Intervenor/Defacto complainant had given a complaint against the petitioner before the 1st respondent Inspector of Police, District Crime Branch, Vellore, and based upon the complaint given by the Intervenor/defacto

complainant the same has been registered as Crime No.1 of 2014 and the petitioner had approached this Hon'ble Court by filing petition anticipatory bail in Crl.O.P.No.7672 of 2014 and during the pendency of the above said Crl.O.P. The same has been referred to the mediation proceedings by this Hon'ble court by order dated 18.07.2014.

3.The petitioner has settled the issue amicably with the intervenor/defacto complainant and the defacto complainant had also executed the memorandum of understanding and also issued the receipt for the payment full and final in the petitioner herein and hence the defacto complainant had come forward to withdraw the complaint given against the petitioner in Crime No.1 of 2014 on the file of the 1st respondent police.

4.The intervenor/defacto complainant is ready to execute the petitions and other formalities in withdrawing the complaint filed against the petitioner in Crime No.1 of 2014 on the file of the 1st respondent police.

5.That the Intervenor/defacto complainant hereby declares that there is no claim against the petitioner and hereby agrees to withdraw all the allegations and also to withdraw the complaint against the petitioners pending before the Inspector of Police, District Crime

Branch, Vellore in Crime No.1 of 2014."

In terms of settlement arrived at between the parties which is recorded under the Mediation Agreement by the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, in its Report dated 30.03.2015, this criminal original petition is disposed of recording the Mediation Agreement. The Mediation Agreement and the report of the Mediation Centre shall form part of this order. mra 18.06.2015
