ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 8(c) r/w 20 (b) (ii) (B) of NDPS Act in Cr.No.166 of 2022, on the file of the respondent police, seek anticipatory bail.

2. This petition has been filed seeking anticipatory for the alleged offence under Section 20 (b) (ii) (B) of NDPS Act. The petitioner apprehends arrest at the hands of the respondent police since 1.2 kgs of ganja was recovered from the accused and hence he was impleaded as petitioner herein in this case. Since the petitioner herein is absconded, the police is not able to investigate the matter further.

3. This court taking note of the provisions of NDPS Act and averments made in the FIR is of the view that the petitioner is not entitled for anticipatory bail since materials are available against the petitioner and the said act indicates his involvement in the crime, this court is not inclined to grant anticipatory bail to the petitioner.
