Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for all relevant records relating to the impugned order of Compulsory Retirement issued in Proceedings No.DGM(ALR)/IR/DA/77/2005-2006 dated 07.05.2005 passed by the Deputy General Manager, Indian Overseas Bank, Central Office, No.763, Annasalai, Chennai-600 002, the 4th respondent herein and quash the same as arbitrary, unreasonable, improper, illegal, violating the rules and regulations and principles of natural justice and thereby direct the respondents herein to reinstate the petitioner into service with all backwages, continuity of service and with all monetary and other consequential benefits.

When the matter was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner passed away five years ago and when he contacted the petitioner's wife, it was informed that the petitioner's legalheirs are not interested in proceeding with the matter. He further submitted that the present petition may be closed with liberty to the legalheirs of the deceased- petitioner to reopen the matter, in case they decide to pursue the same in future.

2. In view of the above submission, without going into the merits of the matter, this Writ Petition is closed, by granting the aforesaid liberty sought for. No costs. Consequently, connected miscellaneous petition is closed.
