This application is filed to record defendants 2 to 4 in the suit namely 1.Pushpa Narayanasamy, 2. Padma Narayanasamy and

3. Alamelu Narayanasamy as the legal heirs of the deceased 1st defendant in the above suit.

2. I heard the learned counsel for the applicant/plaintiff and the learned counsel for the respondents/defendants.

3. The learned counsel for the applicant submitted that the 1st defendant Mr.Janaki Narayanaswamy died intestate on 12.01.2020 leaving behind defendants 2 to 4 in the suit as her only Class I legal heirs. In view of the fact that the said legal heirs are already parties to the suit as defendants 2 to 4, he submitted that the present application is filed to record the above fact.

4. The learned counsel for the respondents submitted that he has no objection if this application is allowed. 1/2 http://www.judis.nic.in

Upon considering the submissions of the learned counsel for the respective parties and on examining the affidavit filed in support of the application, I find that this application is liable to be allowed because the only legal heirs of the deceased 1st defendant are defendants 2 to 4, who are already on record. Accordingly, this application is allowed by recording that defendants 2 to 4 are the legal heirs of the deceased 1st defendant.
