Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to pay the Death cum Retirement benefits as sanctioned in the order Na.Ka.No.M/4/1118/2016 dated 17.03.2017 of the second respondent Assistant Commissioner, Salem Corporation and direct them to pay the DCRG arrears of amount with liable interest.

ORDER

The petitioner is a retired Sanitary Inspector from the Salem Municipal Corporation. After joining the post of Health Assistant on 10.1.86, he was promoted as Sanitary Inspector. However, after rendering long years of service, on reaching the age of superannuation, he retired from service with effect from 31.5.2016 and finally his appeal was also disposed of by the Government in G.O.Ms.No.423, Municipal Administration and Water Supply Department dated 13.10.2016 granting relaxation and thereafter his terminal benefits were also sanctioned by the order dated 17.3.2017. But the grievance of the petitioner is that the terminal benefits have not yet reached his hands. Therefore, he has given a representation on 6.11.2017. However, finding inaction on the part of the respondents, he has come to this Court.

2. The learned standing counsel for the respondents submitted that the representation of the petitioner will be acted upon on the basis of the order dated 17.3.2017 sanctioning the terminal benefits to the petitioner.

3. In view of the above, the respondents are directed to implement the order dated 17.3.2017, by disposing of the petitioner's representation dated 6.11.2017, within a period of four weeks from the date of receipt of a copy of this order.
