Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Respondents to consider the request of District to District transfer of petitioner as B.T. Assistant (Mathematics) Teacher from Pallipet Union Middle school, Kakallur, Pallipet Union, Thiruvallur District to the school in which the said vacancy is available in Thuckalay Block, Kanyakumari District in the General transfer and promotion counselling going to be held on 23.02.2022 based on the representation of the petitioner dated 01.02.2022.

ORDER

The learned counsel for the petitioner submitted that the petitioner is an Msc., B.Ed Graduate in Mathematics, hailing from Kanyakumari District. The petitioner was appointed as P.G Assistant (Mathematics) at Panchayat Union Middle School, Kakkalur, Pallipet Block, Thiruvallur on 24.08.2010 and she was continuing her service in the same school for the post twelve years.

2. The learned counsel for the petitioner further submitted that the 2nd respondent published the B.T Assistant (Mathematics) Teachers vacancies available in the High Schools throughout Tamil Nadu in District and Block wise. The petitioner has made representation dated 01.02.2022 to the 2nd & 3rd respondents requesting to transfer from the present school to any of the schools at Kanyakumari District as per G.O.(MS)No. 243 School Education (ee3)(2) department, dated 30.11.2013, Since no action has been taken by the respondents on the said representation, the present writ petition is filed.

Considering the limited scope of the prayer sought for by the petitioner and taking note of the fact that the transfer counseling is scheduled to be held on 02.03.2022, this Court, without expressing any of the opinion on the merits of the case, directs the 3rd respondent to consider the petitioner's representation dated 01.02.2022 and pass appropriate orders on merits, in accordance with law within a period of one week from today.

4. With the above directions, the writ petition stands disposed of. No costs. Consequently connected Miscellaneous Petition is closed.
