C.M.P.No.13871 of 2024 in C.M.A.Sr.No.48296 of 2022 N.ANAND VENKATESH , J This Civil Miscellaneous Petition has been filed seeking to condone the delay of 649 days in paying the deficit court fee.

2. Notice to first respondent is dispensed with since the first respondent remained ex parte before the Tribunal.

3. Ms.R.Rathna Thara, learned counsel, takes notice on behalf of second respondent.

4. Heard learned counsel on either side.

5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 649 days in paying the deficit court fee is condoned.

6. Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.

7. Registry is directed to print the name of Ms.R.Rathna Thara, learned counsel for second respondent, at the time of admission.

It is made clear that for the period of delay of 649 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
