Respondent PRAYER: Writ petition filed under Article 226 of the Constitution of India, for a Writ of Certiorarified Mandamus, calling for the records relating to order passed by the respondent in Memo.No.CMD/NLC/42/2010 dated 13.04.2010 and quash the same and consequently direct the reinstatement of the petitioner with back wages, continuity of service and all other attendant benefits.

ORDER

The petitioner got a Scheduled Tribe certificate on the ground that he belongs to 'Jenu Kuruba' case which has been declared as Scheduled Tribe by the State of Karnataka and by the Government of India.

2. A charge memo was issued on the ground that the certificate has been wrongly obtained and that the peritioner is not entitled to the benefits. This was challenged by the petitioner by filing WP.No.23578 of 2006 dated 02.12.2009, for a direction to reinstate the petitioner. This Court after relying on G.O.No.SWD/713/SAD/93 dated 11.03.2002 directed that in terms of the G.O.No.SWD/713/SAD/93 dated 11.03.2002, the case of the petitioner can be considered for appointment under backward class category subject to the conditions prescribed therein.

3. This Court was also directed the petitioner to make a representation to the appropriate authority seeking their indulgence in terms of the above said Government order. The petitioner's representation has been rejected by the order impugned herein. The rejection of the representation is of the year 2010. Nine years have passed. At this length of time, it will be futile to consider the correctness or otherwise of the representation of the petitioner and the order rejecting the case.
