O R D E R

This petition has been filed challenging the order passed by the Court below partly allowing the application filed by the petitioner under Section 91 of Cr.P.C. 2.The petitioner is facing proceedings before the Court below under Section 138 of Negotiable Instruments Act initiated by the respondent. The proceedings were initiated in the year 2012 and it is pending till date. 3.Heard the learned counsel appearing for the petitioner and the learned counsel appearing on behalf of the respondent.

4.This Court does not find any illegality or infirmity in the order passed by the Court below and there are no grounds to interfere with the same.

5.In the result, this Criminal Original Petition is dismissed and the Court below is directed to complete the proceedings in S.T.C.No.218 of 2012 within a period of two months from the date of receipt of a copy of this order. The presence of the petitioner is dispensed with and he shall be represented by a counsel, who shall cross examine the witnesses on the same day they are examined in chief. The petitioner shall be present before the Court below at the time of questioning under Section 313 of Cr.P.C. and at the time of final judgment. Consequently, connected Miscellaneous Petition is closed.
