ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the respondent to issue patta in the name of the petitioner for Page No.1 of 4

the property morefully described in the prayer to this writ petition, within a time frame to be fixed by this Court.

2. A counter affidavit has been filed by the respondent. In the counter affidavit, the respondent stated that since the petitioner has produced an unregistered document, the petitioner may not be entitled for patta as prayed for in this writ petition.

3. However, admittedly, the petitioner's representation given to the respondent seeking for issuance of patta prior to the filing of this writ petition, has not been considered by passing final orders in the said representation. Necessarily, the petitioner will have to produce all relevant documents in support of his request for grant of patta.

4. No prejudice would be caused to the respondent, if the petitioner's representation seeking for issuance of patta is considered on merits and in accordance with law, within a time frame to be fixed by this court, after hearing the objections, if any, from the neighbouring land owners as well as any third party as they deem fit. 5. This Court is not expressing any opinion on the merits of the petitioner's representation dated 10.01.2025.

6. For the foregoing reasons, this Writ Petition is disposed of, by directing the respondent to pass final orders on merits and in accordance with law, on the petitioner's representation, dated 10.01.2025 seeking for issuance of patta in the name of the petitioner for the property morefully described in the prayer to this writ petition, based on the supporting documents produced by the petitioner, after hearing the objections of the neighbouring land owners as well as any other party, whom the respondent deems fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
