ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the respondents to disburse the balance subsistence allowance of Rs. 6,41,639/- together with 10% interest.

2. With the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.

3. The learned counsel appearing for the petitioner would submit that while the petitioner was working as Secretary of the 3rd respondent Society, he was placed under suspension for the misappropriation committed from 12.01.2022 and later he was terminated from service on 26.09.2024. However, during the suspension period, the respondents have not disbursed subsistence allowance to the petitioner therefore, the petitioner made a representation dated 04.12.2025 to the respondents seeking subsistence allowance for the said period. Since no order was passed, the petitioner is before this Court.

4. The learned Special Government Pleader appearing for the respondents would submit that the 3rd respondent will consider the representation of the petitioner and pass appropriate orders on the same within a specified time.

5. In view of the above, there will be a direction to the 3rd respondent to consider the petitioner's representation dated 04.12.2025 and pass appropriate orders on the same in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

6. This Writ Petition is disposed of with the above terms. No costs. 16-02-2026 Index: Yes/No Speaking/Non-speaking order KKN
