Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Certiorarified Mandamus, praying to call for the records relating to the first respondent's proceedings made in Na.Ka.A2/1252/2018 dated 10.10.2018 and quash the same and direct the second respondent retain the petitioners name in revenue records with

respect to petitioner's patta land comprised in S.No.484/3B, 484/3C, 484/3D over an extent of 0.33.0 ares (0.81 Cents) 483/1A, 1B, 1C, 1D, 1E, 1F, 484/3A and 484/3E of Kappalur Village, Kalasappakkam Taluk, For Petitioner : Mr.M.Muthappan For R1 & R2 : Mr.T.Arun Kumar Additional Government Pleader For R3 : Mr.S.Ambigapathi

ORDER

This Writ Petition has been filed challenging the order dated 10.10.2018 passed in Na.Ka.A2/1252/2018 by the first respondent, thereby ordered to include the name of the third respondent herein in the patta issued in favour of the petitioners in respect of the subject property.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. A perusal of the records reveals that, in respect of the subject property, a civil suit in O.S.No.775 of 2018 is pending on the file of the District Munsif Court, Polur.

4. In view of the above, this Court finds no infirmity or illegality the order dated 10.10.2018 passed in Na.Ka.A2/1252/2018 by the first respondent. However, the petitioners are at liberty to approach the revenue authorities seeking cancellation of the patta issued in favour of the third respondent, subject to the outcome of the civil suit, in the manner known to law.

5. In the result, this Writ Petition stands dismissed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
