Comp.A.No.54 of 2022 Comp.A.No.54 of 2022 in C.P.No.276 of 2016 KRISHNAN RAMASAMY, J., This application was filed under Section 446(2) of the Companies Act for the reliefs stated in the application.

2. The learned Official Liquidator would submit that he has taken over the charge of assets and liability subsequent to the order dated 18.10.2016 made in C.P.No.297 of 2016. By virtue of the said order, M/s.KRM Kumaragam Chits Private Limited has been wound up. As per the statement of affairs filed by the Ex-Director on 27.02.2018, the respondent claimant to pay a sum of Rs.5,00,000/-. Hence, the learned Official Liquidator sent a demand notice on 15.03.2018 and reminder notice was also sent on 12.03.2018 to the debtor. Though, the notice was also ordered in this application and service of the same was completed and also the name of the respondent was printed in the cause list, none appeared for the respondent today. This shows that the respondent is not interested to contest this matter and therefore, the respondent is set ex-parte.

5. Upon hearing the Official Liquidator and perusing the materials available on record, this Court is satisfied that the respondent is liable to pay a sum of Rs.5,00,000/- and hence, the learned Official Liquidator has also proved the claim.
