ORDER

The petitioner who was arrested and remanded to judicial custody on 26.12.2025, for the offences punishable under Section 318(4) of BNS, 2023 and 66(D) of Information Technology Act, 2000, on the file of respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was ranked as A2 in this case. The petitioner, along with other accused consisting group of 8 persons, used to send WhatsApp messages, claiming and impersonating themselves as prominent members of the society or the persons close to the victims demand money and received the same. In this case, they sent the message to the Executive Assistant of the Company to transfer a sum of Rs.23 lakh as if it was posted by Managing Director of the de-facto complainant's company. Accordingly, the Executive Assistant has transferred a sum of Rs.23 lakh to various accounts as per the instructions and subsequently, it revealed that it was a scam. Hence, the has been registered. Based on the investigation, some of the accused were arrested and revealed that a sum of Rs.

4,70,000/- was deposited into the bank account of A2, and further investigation is pending. 3.The learned Counsel for the petitioner submitted that the petitioner has not collected any money through bank account and the petitioner is ready to deposit the entire amount and he is not having any other case. He prayed to grant bail to the petitioner.

4.Mr.A.Gopinath, learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that some of the co-accused still absconding and the money was not yet recovered. He further submitted that investigation is going on and he opposed to grant bail to the petitioner.

5.Considering the fact that this is a clear case of online fraud, the investigation is pending, and so far money is not yet recovered, and if bail is granted to the petitioner it would lead to tamper the investigation; further the activities of accused Spah into PAN-India investigation , hence, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition shall stands dismissed. 09.02.2026 MSM To 1.The Inspector of Police, CCW-Avadi City Police Station Avadi City.
