O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to issue patta in the name of the petitioner with respect to the subject property by considering the representation dated 07.01.2025.

2. Heard Mr.S.Gunaseelan, learned counsel for petitioner and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader appearing for respondents.

3. The case of the petitioner is that his mother is the owner of the subject property by virtue of a registered sale deed dated 13.04.1999. Based on some claim made by a third party, the patta that stood in the name of the petitioner's mother in Patta No.292 was cancelled by the second respondent in the year 2009. Thereafter, a suit was filed before the competent civil Court and the suit was decreed by judgment and 2/4

decree dated 11.07.2013. Based on the same, a representation was made before the first respondent and the first respondent, through proceedings dated 27.04.2015, directed the second respondent to consider the decree passed in the suit and to take a decision. In the mean time, in the year 2021, the mother of the petitioner settled the property in favour of the petitioner through a registered settlement deed dated 10.02.2021. The grievance of the petitioner is that the second respondent is keeping the representation pending and patta is not transferred in the name of the petitioner. It is under these circumstances, the present writ petition has been filed before this Court.

4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to take a decision within a period of six (6) weeks pursuant to the order passed by the first respondent dated 27.04.2015.
