O R D E R

The present writ petition has been filed for writ of Certiorarified Mandamus to call for the records dated 10.03.2010 and quash the same and further direct the respondent to grant approval for name change from Johnson Matthey Ceramics India Private Ltd. to Endeka Ceramics India Private Ltd which is the present name of the Petitioner Company without levy of any charge as indicated in the impugned letter.

The learned counsel for the petitioner would submit without going into the merits of the matter that there was a confusion in the application and hence prays for liberty to file fresh application indicating the name of the Company which was mentioned in the Lease Deed along with necessary documents for change of company name in the Lease Deed.

3. The learned counsel appearing for the respondent would submit that if any application is filed, the same would be considered in the manner known to law within a stipulated time as prescribed by this Court.

4. Considering the above facts, without expressing any opinion on the merits of the matter, I am inclined to grant permission to the petitioner to file fresh application along with necessary documents. Hence, liberty is granted to the petitioner to file fresh application indicating the name of the Company which was mentioned in the Lease Deed along with necessary documents for change of Company name in the lease deed. If such application is filed by the respondent within a period of two weeks from the date of receipt of a copy of this order, the respondent has to pass order within a period of six weeks from the date of receipt of such application.

5. The writ petition stands disposed of with the above observation. No costs.
