This Writ Petition (Criminal) has been filed seeking a direction to the 1st respondent to provide certified true copies of the complaint and all connected records and materials pertaining to the unclosed C.S.R. No. 453 of 2025, dated 31.08.2025, registered at Nolumbur V7 Police Station, pursuant to and in consideration of the petitioner's representations dated 29.10.2025 and 13.01.2026.
2. The petitioner had sent a representation on 29.10.2025, followed by another representation dated 13.01.2026, seeking copies of the complaint filed against him, copies of statements, if any, recorded pursuant thereto, and a copy of the minutes of the General Body Meeting held on 30.08.2025, which forms the subject matter on C.S.R.No.453 of 2025. However, the said copies have not been furnished to the petitioner. Hence, the present petition has been filed.
3. The contention of the petitioner is that he lodged a complaint on 31.08.2025, which was assigned C.S.R.No.454 of 2025. The petitioner is a member of the Jains Nakshatra Flat Owners Association. During the General 2/6
Body Meeting, one Rajan, Chairman, Zone-11, Chennai Corporation, allegedly informed the association members to encroach upon Government park land, and discussions were held in that regard. The petitioner objected to the same.
3.1. At that point of time, on the instructions of the said Rajan, video recording was commenced and attempts were made to assault the petitioner. Consequently, he lodged a complaint. However, no action has been taken except assigning C.S.R. No. 454 of 2025. Thereafter, the petitioner submitted a representation to the Deputy Commissioner of Police and subsequently filed a petition under Section 175(3) before the Judicial Magistrate, Ambattur, in Crl.M.P.No.2094 of 2025, seeking registration of an FIR on his complaint.
3.2. He further submitted that he has now come to know that a counter-complaint has been registered in C.S.R.No.453 of 2025. According to the petitioner, the said complaint is supported by false documents. Hence, in order to expose the falsity of the counter-complaint, he requires the relevant documents.
4. The learned Additional Public Prosecutor for the respondents 3/6
submitted that on the complaint of the petitioner, C.S.R.No.454 of 2025 was assigned and enquiry is pending. Likewise, on the complaint against the petitioner, C.S.R.No.453 of 2025 has been assigned, in which enquiry is also pending. It is further submitted that due to the elections and the transfer of the Inspector, the enquiry could not be completed immediately and consequently took some time. After the general elections, both the CSRs would be taken up for enquiry and in any event, the enquiry would be completed within a period of two months.
4.1. He further submitted that prior thereto, notice would be issued to the petitioner for his appearance and before his appearance, the materials against him would be furnished to enable him to offer his explanation.
5. Recording the above, this Writ Petition (Criminal) is disposed of. No costs.
