This Writ Petition has been filed to direct the respondents 1 to 3 not to transfer the patta Nos.679, 831, 3165 and 1945 in the name of the 5th respondent for the properties morefully described in the prayer to this writ petition.
2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed against the respondents 4 and 5 in this writ petition, notice to the respondents 4 and 5 is dispensed with by this Court.
3. According to the petitioner, the 5th respondent is attempting to transfer the aforesaid pattas in his name. Therefore, the petitioner in this writ petition has sought for a prayer to forbear the respondents 1 to 3 not Page No.2 of 6
to transfer the subject pattas in the name of the 5th respondent or any other third party. He had given a representation on 02.01.2025 for the said purpose. Since the same was not considered, the petitioner has filed this writ petition.
4. Necessarily, if any application is filed either by the respondents 4 and 5 or any other third party seeking for transfer of subject pattas, which now stands in the name of the petitioner and his mother, the petitioner and his mother will have to be given an opportunity to object the same by raising objections and only after hearing their objections, the request for transfer of patta in the name of the third party can be decided by the official respondents.
5. For the foregoing reasons, this Court directs the respondents 1 to 3 to issue notice to the petitioner and his mother and hear their objections whenever any application is filed by any third party or by the respondents 4 and 5 seeking for transfer of patta in their name for the properties morefully described in the prayer to this writ petition, which is the subject matter of patta Nos.679, 831, 3165 and 1945.
