O R D E R

This petition has been filed to direct the respondent not to harass the petitioner under the guise of conducting an enquiry on the complaint dated 05.02.2020.

2. The learned counsel for the petitioner has submitted that based on the complaint given by one Gomathi against the petitioner, an FIR in Crime No.853 of 2019 dated 16.09.2020 was filed under Sections 341, 294(b), 323 of IPC and under Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 Act. He further submitted that in the said case the petitioner was arrested and subsequently, he was released on bail and even thereafter, the respondent is unnecessarily harassing the petitioner.

3. The learned Government Advocate has submitted that since the FIR was registered in Crime No.853 of 2019 against the https://hcservices.ecourts.gov.in/hcservices/

petitioner only for investigation purpose in the said complaint, he was called and he was not subjected to any harassment.

4. Since the petitioner was already arrested and subsequently released on bail in Crime No.853 of 2019, unless a fresh complaint is received, the respondent should not harass the petitioner under the guise of investigation.

5. With the aforesaid directions, this Criminal Original Petition is disposed of.
