The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.7 of the order dated 12.01.2023 passed by this Court in Crl.O.P.No.24201 of 2022 while granting interim anticipatory bail.
2. The learned counsel for the petitioner would submit that one of the conditions imposed on the petitioner is that "the petitioner should execute a bond for a sum of Rs.10,000/- with two sureties (out of which, one must be a blood related surety), for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned. He would further submit that the petitioner's parents and his sister are at USA and hence, blood surety is not available. But, the petitioner's wife is ready to execute the surety instead of blood related surety. Hence, he would seek modification and also to modify the date of installment insisted by this Court.
3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.
4. Taking into consideration, the facts and the submissions made 1/3
by the learned counsel for the petitioner, this petition is allowed by modifying the condition to the effect that " the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties, out of which, one surety shall be a close relative ie., wife of the petitioner for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and the date of installment insisted by this Court is also modified to the effect that the first installment Rs.2,00,000/- to be paid on or before 09.03.2023 and the second installment Rs.3,00,000/- to be paid on or before 30.03.2023. All other conditions remain intact.
5. With the above modifications, this Criminal Miscellaneous Petition is allowed.
6. Post the matter on 31.03.2023 for reporting compliance, till then interim anticipatory bail already granted by this Court dated 12.01.2023 is extended.
