The respondent in the Original Side Appeal has filed the above Civil Miscellaneous Petition seeking permission to withdraw a sum of Rs.17,99,601/- [Rupees Seventeen lakhs ninety nine thousand six hundred and one only] lying to the credit of the Original Side Appeal in O.S.A.No.225 of 2017.

2. The learned counsel appearing for the respondent-Insurance Company has no objection for permitting the petitioner to withdraw the said amount.

3. In view of the same, the petitioner is permitted to withdraw a sum of Rs.17,99,601/- [Rupees Seventeen lakhs ninety nine thousand six hundred and one only] lying to the credit of O.S.A.No.225 of 2017. Page 1/3

4. The learned counsel appearing for the respondent-Insurance Company submitted that the Insurance Company may be directed to withdraw the balance amount lying to the credit of O.S.A.No.225 of 2017 together with accrued interest, for which, the learned counsel appearing for the petitioner has no objection.

5. In view of the same, the respondent-Insurance Company is also permitted to withdraw the balance amount lying to the credit of O.S.A.No.225 of 2017 together with accrued interest. With the above observations, the above Civil Miscellaneous Petition is disposed of.
