JUDGMENT

[Judgment of the Court was delivered by M.SATHYANARAYANAN, J.] The learned counsel appearing for the appellant seeks the permission of this Court to withdraw the writ appeal and he has also made an endorsement in the writ appeal to that effect. The Court heard the submissions of Mr.A.N.Thambidurai, learned Special Government Pleader appearing for the 1st respondent and MrV.Jayaprakash Narayanan, learned counsel appearing for the 2nd respondent.

In view of the submission and endorsement made by the learned counsel appearing for the appellant, this writ appeal is dismissed as withdrawn. No costs. Consequently, the connected miscellaneous petition is also dismissed. It is made clear that if any fresh cause of action arise and if the appellant is so advised and if it is available under law, he may pursue the same.
