PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the second respondent to consider the petitioner's claim for compassionate appointment based on the third respondent's proposal in Na.Ka.No.AA/370/2016 dated 13.12.2019 within a time frame that may be fixed by this Court. This writ petition has been filed for the issue of writ of mandamus, directing the second respondent to consider the claim made by the petitioner for compassionate appointment based on the proposal that has already been forwarded by the third respondent by his letter dated 13.12.2019.
2.The case of the petitioner is that her father was working as a Watchman in a Government School. He died on 01.11.2016, while he was in service. The petitioner made an application on 05.10.2019 before the third respondent seeking for compassionate appointment. The third respondent, after considering the same, has forwarded it to the second respondent and the same is pending. Therefore, the present writ petition has been filed before this Court seeking for appropriate directions. 3.Heard Mr.G.Balamanikandan, learned counsel for the petitioner and Mr.P.S.Sivashanmuga Sundaram learned Special Government Pleader appearing for the respondents. 4.
Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the second respondent to consider the request made by the petitioner for compassionate appointment in line with the proposal that has already been forwarded by the third respondent by his letter dated 13.12.2019 and pass appropriate orders, within a period of 8 weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the second respondent along with the copy of the application dated 05.10.2019, copy of the third respondent's proposal dated 13.12.2019 and a copy of this order.
5.This writ petition is disposed of with the above direction. No costs.
