Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus in respect of the Ref. No. 119998/N1/2025 on 07.01.2026 issued by the third respondent, quash the same and direct the respondents herein, to transfer from Nagapattinam Government Medical College and Hospital to Tirunelveli Government Medical College and Hospital or any other Government Medical Institution in Tirunelveli District.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus in respect of Ref. No.119998/N1/2025 on 07.01.2026 issued by the third respondent, quash the same and direct the respondents, to transfer from Nagapattinam Government Medical College and Hospital to Tirunelveli Government Medical College and Hospital or any other Government Medical Institution in Tirunelveli District.
2.The learned counsel appearing for the petitioner submitted that the petitioner is working as Staff in Nagapattinam Government 2/6
Medical College and Hospital and she made representation to the official respondents seeking to transfer her from Nagapattinam Government Medical College and Hospital to Tirunelveli Government Medical College and Hospital or any other Government Medical Institution in Tirunelveli District and since the same was not considered, the petitioner filed W.P.No.27502 of 2025 and this Court vide order dated 28.07.2025 directed the respondents therein to consider the petitioner's representation and to pass orders and even thereafter there was no response and hence the petitioner issued pre contempt notice, thereby the present impugned order was issued to the petitioner.
3.The learned counsel appearing for the petitioner further submitted that in the impugned order it is stated that there is no vacany in Tirunelveli District. Hence, this Court may without going into the merits of the case, permit the petitioner to make fresh representation to the official respondents, if any vacancy arise in Tirunelveli District in future and issue direction to the official respondents to consider the same and to pass appropriate orders. 3/6
4.The learned Government Advocate appearing for the respondents 1 to 4 submitted that in future, if the petitioner makes any representation to the respondents 1 to 4, the same will be considered and appropriate orders will be passed. 5.Considering the limited relief now sought for by the learned counsel appearing for the petitioners, this Court, without expressing any opinion on the merits of the case, grants liberty to the petitioner to make fresh representation to the official respondents, if any vacancy arise in Tirunelveli District in future. If the petitioner makes any such representation, the official respondents shall consider the same and pass appropriate orders.
